These Terms of Service ("Terms") govern your use of Nexus AI's AI assistant services, including our website, browser extension, and mobile applications (collectively, the "Services"). By using our Services, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that you are at least 13 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

2. Description of Services

Nexus AI provides an AI-powered browser assistant that helps you with tasks including but not limited to:

• Analyzing and summarizing web pages, articles, and documents
• Answering questions about page content and uploaded files
• Generating written content, translations, and explanations
• Extracting data from YouTube, Amazon, LinkedIn, and other platforms
• Code assistance and technical explanations
• PDF and image analysis via file upload

Our Services utilize Google Gemini API to process your AI requests. The quality and accuracy of AI responses are not guaranteed. AI is a tool, not a replacement for professional judgment.

3. Account Registration

To use our Services, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscription Plans & Billing

4.1 Plans

We offer various subscription plans with different features and usage limits. Current plans and pricing are displayed on our website and may change with 30 days notice.

4.2 Payment

Payments are processed securely through Paddle, our Merchant of Record (PCI-DSS compliant). Subscriptions are billed monthly in advance. You authorize Paddle to charge your payment method for recurring subscription fees. Paddle handles all billing, tax collection, and invoicing on our behalf.

4.3 Cancellation & Refunds

• You may cancel your subscription at any time through your dashboard.
• Cancellation takes effect at the end of your current billing period.
• Our Refund Policy is available at https://nexusbrowserai.com/refund and provides a full refund if requested within 14 days of purchase.
• Free plan features remain available after cancellation.

5. Acceptable Use

You agree NOT to use our Services to:

• Generate illegal, harmful, or discriminatory content
• Harass, threaten, or impersonate others
• Distribute malware, spam, or phishing content
• Attempt to bypass usage limits or security measures
• Scrape, reverse engineer, or misuse the Services
• Violate any applicable laws or regulations
• Generate content that violates third-party rights
• Use automated tools without authorization

Violation of these terms may result in immediate account suspension or termination without refund.

6. AI Content Disclaimer

IMPORTANT — PLEASE READ CAREFULLY:

• AI-generated content may contain errors, inaccuracies, fabricated facts ("hallucinations"), or outdated information
• AI responses are not professional advice — do not rely on them for legal, medical, financial, tax, or safety decisions
• You are solely responsible for reviewing, verifying, and validating all AI outputs before use in any context
• We do not guarantee the accuracy, completeness, reliability, or suitability of any AI response
• AI may occasionally produce inappropriate, biased, or offensive content despite our safety measures
• AI-generated code should be tested thoroughly before use in production environments
• AI outputs may reflect biases present in training data and should not be treated as objective truth

Data handling: Your prompts and page context are sent to Google Gemini API for processing. Under the Gemini API Terms of Service, your data is not used to train AI models. See our Privacy Policy for full details on how your data flows through our system.

7. Intellectual Property

7.1 Our Rights

All rights to the Services, including software, design, and branding, are owned by Nexus AI. You receive only a limited license to use the Services as permitted by these Terms.

7.2 Your Content

You retain ownership of content you submit (prompts, context). By submitting content, you grant us a license to process it through the Services and third-party AI providers as necessary to provide the Services.

7.3 AI Outputs

Subject to these Terms and your subscription, you may use AI-generated outputs for personal and commercial purposes. However, the same outputs may be generated for other users, and we make no claims of exclusivity.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE LAST 12 MONTHS

9. Indemnification

You agree to indemnify and hold Nexus AI harmless from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

10. Modifications to Services

We reserve the right to modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable notice for significant changes that affect your subscription.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Services. Continued use after changes constitutes acceptance.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your right to use the Services immediately ceases
• We may delete your data in accordance with our Privacy Policy
• Provisions that should survive termination will remain in effect

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Nexus AI is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
